Former President Trump Asks Top Court Approval for State Guard Personnel in Illinois

Court Fight Over Military Presence

In an emergency filing, the US Department of Justice urged the court to overturn a lower court ruling that had blocked the deployment of hundreds of military reserve troops to the greater Chicago.

The presiding judge had expressed skepticism about the government's reasoning for activating the guard, questioning its explanation in light of local conditions.

A federal appeals court upheld the lower court’s decision on Thursday, maintaining the deployment on pause while the legal challenge proceeds.

Administration's Justifications

The federal legal representative, acting for the White House, claimed in the latest petition that federal law enforcement have often been “threatened and targeted” in Chicago and the neighboring town of Broadview.

This location is home to an Immigration and Customs Enforcement holding center.

The president has already sent state guard forces to the Windy City and Portland, following earlier sendings to Los Angeles, California, the city of Memphis, and Washington, District of Columbia.

The president has argued that armed forces involvement is needed to control demonstrations and bolster border control.

Political Pushback

Democratic officials have pushed back sharply the move, arguing that the administration's assertions are greatly exaggerated and driven by politics.

At the core of the conflict is the president’s use of a federal statute authorizing the executive branch to nationalize the state guard only in instances of insurrection or when “unable with the standard military to enforce the regulations of the nation”.

The government argues that the personnel are essential to defend US facilities and officers from demonstrators.

Previously, the White House federalized several hundred members of the state guard of Illinois and directed extra guard from Texas troops into the region.

As state authorities condemned the decision, the White House increased his statements, urging the arrest of Chicago’s mayor and the governor of Illinois, each a Democrat, charging them of neglecting to safeguard immigration officers.

State authorities and the city of Chicago filed a combined lawsuit the White House to halt the deployment.
